These Terms of Service (“Terms”) govern your access to and use of BrineAndBlade.com, BrineAndBlade.Substack.com, and all related content, products, and services (collectively, the “Services”). By using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. WHO WE ARE

“Brine & Blade,” “we,” “us,” or “our” refers to the creator and owner of the Brine & Blade universe — an independent creative project releasing original stories, music, videos, art, lore, and merchandise.

The Services may include:

Paid and free Substack newsletter issues

Podcasts, narrated stories, and audio productions

Original music and mixes

Videos and cinematic battles

2. ACCEPTANCE OF TERMS

By accessing or using the Services, you represent that:

You are at least 13 years old (or the age required in your jurisdiction).

You have read these Terms and agree to them.

You will comply with applicable laws and respect our intellectual property.

3. CHANGES TO TERMS

We may update these Terms at any time. Updates take effect upon posting. Continued use of the Services means you accept the updated Terms.

4. INTELLECTUAL PROPERTY

Unless otherwise stated, all content on the Services — including but not limited to:

music

lyrics

stories, lore, and worldbuilding

videos and animations

artwork, concept images, and graphic designs

AI-assisted creative work

branding, logos, site design

digital downloads, PDFs, and written materials

— is owned by or licensed to Brine & Blade and protected by copyright and trademark law.

You may NOT:

copy, redistribute, or reproduce any content commercially

upload our content to your own channels without permission

resell, repackage, or mint (e.g., NFTs) our content

use content for AI model training, dataset creation, or similar uses

misuse or impersonate Brine & Blade branding

You MAY:

share public links

quote small portions with attribution

use for personal enjoyment

react to or review content in fair-use contexts

Paid or premium content may not be publicly shared.

5. ACCOUNTS & SUBSCRIPTIONS

When using Substack or any connected platform:

you must provide accurate information

you are responsible for your login credentials

you may not share access to paid content

you must comply with Substack’s own Terms of Service

We may suspend or terminate accounts for violations of these Terms.

6. PURCHASES & PAYMENTS

We may offer:

digital downloads (music, PDFs, lore packs, art packs)

merchandise

subscriptions and premium tiers

exclusive content, perks, or collectibles

All sales are final unless otherwise noted.
Payments may be processed by third-party vendors such as Substack, Stripe, PayPal, Bandcamp, or Printful.
We are not responsible for third-party errors or outages.

7. USER-GENERATED CONTENT

If you submit content (comments, messages, artwork, feedback, etc.):

You grant us a non-exclusive, worldwide, royalty-free license to display, use, and reproduce the content as part of operating the Services.

You may not upload or post:

illegal, hateful, explicit, or harmful content

copyrighted content you don’t own

spam or advertisements

anything violating another person’s rights

We may moderate or remove content at our discretion.

8. FICTIONAL CONTENT DISCLAIMER

Brine & Blade is a work of fiction.
Names, characters, events, and locations are products of the creator’s imagination.
Any resemblance to actual persons, living or dead, is coincidental unless stated otherwise.

9. AI-ASSISTED CONTENT & USAGE POLICY

Brine & Blade uses artificial intelligence (“AI”) tools and technologies as part of the creative process. These include, but are not limited to:

AI-assisted music or vocal generation

AI-enhanced writing, story ideas, or lore expansion

AI-generated artwork, character concepts, and imagery

AI-driven video sequences or animations

AI-supported sound design, ambience, or effects

9.1 Ownership of AI-Assisted Content

All AI-generated, AI-assisted, or AI-enhanced content created specifically for Brine & Blade is owned by us.
You may not:

use our AI-generated content for commercial purposes

upload our content to AI training datasets

use our content to create derivative works for resale

claim ownership of AI content produced by or for Brine & Blade

9.2 Accuracy & Limitations

AI content may contain:

artistic interpretation

imaginative or exaggerated scenarios

stylized visuals

fictional inaccuracies

You acknowledge that:

AI outputs may not be factually accurate

Some visuals may depict fantasy, myth, or exaggeration

AI-generated characters, images, and events are for creative use only

AI tools are used as part of the artistic workflow, not as a substitute for authorship

9.3 No AI Reuse Without Permission

You may not repurpose, repost, repackage, or reupload Brine & Blade AI-generated assets — especially images, videos, music, or text — for your own projects, whether personal, public, or commercial, without written permission.

9.4 Your Use of the Services

You agree not to:

scrape the site or export content into AI model training

use automated systems to extract, collect, or harvest media

attempt to reverse-engineer AI styles used by Brine & Blade

use our stories, lore, videos, or images as input for your own AI creations without permission

Violation of this policy may result in account suspension or legal action.

10. PROHIBITED USES

You agree not to use the Services to:

break any law

harass, exploit, or harm others

distribute malware or malicious software

interfere with security or site operations

impersonate Brine & Blade or its creator

attempt automated harvesting or scraping

modify or reverse-engineer parts of the Services

11. PRIVACY

Your privacy is important to us.
We only collect information necessary to operate the Services (e.g., email for newsletters, analytics).

Third-party services (Substack, Stripe, etc.) may collect additional information.
